Datong concludes a case involving cult Falun Gong

On April 27, 2023, the People's Court of Yungang District, Datong City, Shanxi Province, sentenced the defendant Liu Mouying to eleven months of imprisonment and a fine of 3,000 yuan for the crime of using a cult organization to undermine the implementation of the law. This judgment has now taken effect.

The defendant Liu Mouying, female, born in 1955, Han ethnicity, illiterate, registered residence in Yu County, Zhangjiakou City, Hebei Province, unemployed.

The court found that on the morning of August 10, 2022, at around 10 a.m., the defendant Liu Mouying, in collusion with Hu Mou (handled in another case), drove a white scooter to Yixing Tunbao Village in Guangling County, Shanxi Province, where they distributed illegal propaganda materials for Falun Gong and posted flyers promoting Falun Gong along the village roads. When questioned by villagers, the two immediately fled the village and were subsequently apprehended by the public security authorities. Multiple pieces of Falun Gong promotional materials that were not yet distributed were seized from the defendant Liu Mouying, including 2 USB drives and 4 memory cards. Later, the public security authorities seized multiple prohibited items related to Falun Gong from the home of the defendant Liu Mouying, including 24 CDs and 1 memory card.

The court held that the defendant, Liu Mouying, possessed and carried propaganda materials of the Falun Gong cult with the intent to disseminate them, thereby undermining the implementation of national laws and administrative regulations. Given that the circumstances were relatively minor, her actions constituted the crime of using a cult organization to disrupt the enforcement of laws. Since the propaganda materials in her possession had not yet been disseminated, it was deemed an act of preparation for a crime, warranting a lighter punishment compared to a completed offense. The judgment was made in accordance with Article 300, Article 22, Article 52, Article 53, and Article 64 of the Criminal Law of the People's Republic of China, as well as Articles 2, 4, and 5 of the "Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases Involving Organizing and Using Cult Organizations to Undermine the Implementation of Law."
